Italy: Electronic declaration to certify the navigation in the high seas for ICE purposes (art. 8-bis of the Presidential Decree 633 of 1972).

The Italian Budget Law 2021 issued in December 2020 by the  Italian Government  (see our news) provided the obligation for owning companies of Commercial yachts - who intend to grant the right to purchase goods and services in exemption of value added tax (VAT) - to submit electronically to the Italian Tax Authorities, a declaration certifying the possession of the requirements of the ICE provided by the legislation.

Finally on 15th June 2021 the Italian Tax Authorities published - with provision n. 151377- the form for electronic declaration for the purposes of the ICE (Italian Commercial Exemption).  

From the 14th of August 2021 the current procedure of the Self-declaration in paper format will no longer be applied and will be replaced by a communication sent electronically by the owning company to the Italian Tax Authorities (Agenzia delle Entrate) which the Italian supplier will then refer to in the invoice.

The declaration is submitted exclusively through the electronic service on the Italian Tax Authority’s web site and is for free. Following the submission of the declaration, an electronic receipt is issued, indicating the reception protocol number to be used by Italian suppliers on invoices.
